Terms of Service

1. Agreement

These Terms of Service govern the use of Nightloom OS ("the Service") provided by Nightloom Roasters, a registered business in Pakistan ("we", "us"). By using the Service, the partner business (the café or restaurant, "you") agrees to these terms.

2. The Service

Nightloom OS is a loyalty and customer-engagement platform comprising a customer-facing display, a staff app, an owner dashboard with analytics and customer intelligence, and optional WhatsApp engagement. Nightloom OS is not a point-of-sale system; it operates alongside your existing POS.

3. Café responsibilities

• Provide accurate business information and keep account credentials secure.
• Operate the loyalty program fairly and honour the rewards you configure for your guests.
• Ensure your use of the Service and of guest data complies with applicable laws in Pakistan.
• Obtain valid guest consent where required, particularly for WhatsApp messaging (see Section 4).

4. Customer opt-in requirements

WhatsApp messaging requires explicit guest opt-in. You must not instruct or attempt to send WhatsApp messages to guests who have not opted in, and you must respect opt-out requests (a guest replying STOP). You are responsible for ensuring consent is genuinely obtained. We may suspend messaging that appears non-compliant.

5. WhatsApp costs & top-ups

WhatsApp messages carry a per-message cost set by Meta. This cost is passed through to you as a usage-based charge or via prepaid top-ups, in addition to your subscription plan. Messaging may be paused if your balance is exhausted. Pass-through rates may change in line with Meta's pricing.

6. Acceptable messaging

Messages sent through the Service must relate to loyalty and legitimate customer engagement, must comply with Meta's WhatsApp Business policies and applicable law, and must not be spam, deceptive, or unlawful. We reserve the right to refuse or stop messaging that breaches these requirements.

7. Suspension & termination

We may suspend or terminate access for breach of these terms, non-payment, or misuse of the Service (including non-compliant messaging). You may stop using the Service at any time; certain data handling on termination is described in our Privacy Policy.

8. Data

Each partner business owns its customer data. We process it to provide the Service as described in our Privacy Policy. You are responsible for your lawful basis to collect and use guest data through the Service.

9. Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or loss of data arising from use of the Service. Nothing in these terms excludes liability that cannot be excluded by law.

10. Governing law

These terms are governed by the laws of Pakistan [governing-law / jurisdiction detail to be confirmed], and the courts of Pakistan shall have jurisdiction over any disputes, subject to confirmation by Nightloom Roasters.
